    MANILA – In a monumental legislative move, the House of Representatives has officially passed House Bill No. 10439, also known as the proposed Access to Medical Cannabis Act, on its third and final reading. This significant decision, made during a plenary session on Tuesday, garnered support from 177 lawmakers, with only nine opposing it and another nine abstaining from the vote. This approval marks a vital step forward in the ongoing discussion surrounding the medical use of cannabis in the Philippines.

    The passage of HB 10439 is a pivotal development in the legal landscape surrounding cannabis in the Philippines. The bill aims to provide access to medical cannabis for qualified patients suffering from various medical conditions. Furthermore, it seeks to establish a Medical Cannabis Office tasked with regulating this new framework, emphasizing the controlled and responsible use of cannabis for therapeutic purposes.

    One of the key proponents of the measure, Surigao del Norte Representative Robert Ace Barbers, illuminated the essence of the bill. He clarified that its primary objective is to facilitate access to medical marijuana for patients in need, akin to how pharmaceutical products are made available. Barbers’ statement underscores the intention behind the legislation: to prioritize patient care and support, rather than promoting recreational use.

    Despite the optimistic outlook from supporters, concerns have been voiced regarding potential misuse. The Chair of the House Committee on Dangerous Drugs articulated a crucial point: “By no means is this bill a gateway to the recreational use of cannabis.” This statement reflects an intention to maintain cannabis on the list of dangerous substances, highlighting a commitment to controlling its use strictly for medical purposes.

    HB 10439 outlines stringent regulations governing medical cannabis, stipulating that access will only be granted to patients through a prescription from accredited physicians. This regulatory framework emphasizes the importance of medical oversight, aimed at ensuring the responsible and informed use of cannabis as a treatment option.

    The proposal also addresses the logistics of medical cannabis cultivation, manufacturing, and distribution for both medical and research purposes. By creating a comprehensive system that governs these processes, the legislation aims to safeguard the integrity of medical cannabis while also facilitating research into its medical benefits.

    Central to the law’s enforcement will be the newly established Medical Cannabis Office, which will operate under the auspices of the Department of Health. This office will be responsible for overseeing the implementation of the law, ensuring compliance with safety and security standards, and cooperating with the Dangerous Drugs Board to minimize the risk of nonmedical or recreational use of cannabis.

    Looking back, a similar initiative, the proposed Philippine Compassionate Medical Cannabis Act, was passed during the 17th Congress in January 2019. However, the bill lost momentum when then-President Rodrigo Duterte rescinded his support, leading to the Senate’s decision not to pursue its equivalent measure. This historical context illustrates the hurdles faced by advocates of medical cannabis legislation, making the recent passage a potentially transformative moment in the current Congress.

    Despite the momentum gained, resistance remains. The Philippine Medical Association has publicly opposed HB 10439, worrying that it may inadvertently pave the way for recreational cannabis legalization. Critics like health reform advocate Dr. Tony Leachon have also raised alarms, emphasizing that the bill seems to be advancing without adequately consulting the medical community. Such concerns highlight the complex conversations surrounding cannabis legislation—balancing between patient needs, public health, and broader societal implications.

    This momentous development in the Philippines’ legislative journey indicates not only a shift in policy but also sets the stage for an ongoing dialogue about medical cannabis’s role in healthcare. As discussions continue, stakeholders from various sectors will need to navigate the nuances of this evolving legal framework, ensuring that it serves the needs of patients while safeguarding public health.
