Allay Consulting Expands into Psilocybin Compliance

A New Chapter in Compliance Consulting

Allay Consulting, a firm based in Portland, Oregon, is poised to make waves in the emerging market for therapeutic psilocybin. Known for its expertise in cannabis regulatory compliance, Allay has announced the establishment of a new division dedicated to offering regulatory compliance services tailored specifically for the legal psilocybin sector. This development comes as various jurisdictions, including Oregon, begin to recognize the potential therapeutic benefits of psilocybin, a psychedelic compound derived from “magic” mushrooms.

    Oregon’s Groundbreaking Legislation

In November 2020, Oregon became a trailblazer by voting to legalize medical psilocybin use and decriminalize it for recreational purposes. This legislation took effect on February 1, 2021, signaling a significant shift in public policy toward psychedelics. Alongside Oregon, cities like Denver; Oakland and Santa Cruz, California; and Somerville, Massachusetts, have also made strides in decriminalizing psilocybin, reflecting a growing acceptance of its potential benefits.

Public Sentiment: A Divided Opinion on Psilocybin

Despite advances in legislation, public opinion surrounding the legalization of psilocybin remains divided. A poll conducted by DHM Research in January 2019 found that approximately 47% of Oregon voters support the legalization of medical psilocybin, closely trailing behind those opposed at 46%. Furthermore, an October 2019 survey by Green Horizons revealed that only 38% of U.S. adults support psilocybin legalization in some form. This split in public sentiment highlights the complexities surrounding the acceptance of psychedelics.

    Federal Status: The Uncertain Terrain

While psilocybin is experiencing a wave of local legislation favoring decriminalization and medical use, it remains classified as a Schedule I substance at the federal level. This discrepancy creates a challenging regulatory landscape, complicating the market for businesses contemplating entry into the psilocybin space. The federal stance on psilocybin continues to be a significant hurdle for industry stakeholders, raising concerns about investment, innovation, and public health safety.

Allay Consulting’s Vision for Psilocybin Services

With the establishment of its psilocybin division, Allay Consulting aims to equip clients entering this new market with the necessary regulatory frameworks to ensure compliance as the industry matures. Kim Stuck, founder and CEO of Allay, emphasizes the critical role of regulatory compliance in establishing a successful and sustainable business model within the psilocybin sector. She states, “Even if psilocybin sales are a couple of years away… having regulatory compliance baked into the business model’s DNA is a key differentiator for long-term success and scalable growth.”

    Founder’s Journey and Firm’s Expertise

Kim Stuck, who founded Allay in 2017 after her tenure with Denver’s public health agency, has established a solid foundation for the firm within the cannabis consulting landscape. By moving Allay to Portland, she has streamlined the firm’s focus towards this growing market while building a team of experts capable of navigating the complexities of psilocybin regulations. Currently, the consultancy consists of five team members with varied expertise in compliance and business strategy.

    Areas of Advisory Services Offered

Allay’s engagement in the psilocybin sector will encompass a broad spectrum of advisory services tailored to meet the needs of industry clients. These services include but are not limited to:

    • Licensing: Navigating the application processes for obtaining necessary permits and licenses.
    • Compliance Audits: Conducting thorough audits to ensure operations meet regulatory standards.
    • OSHA Compliance: Ensuring workplace safety is prioritized according to Occupational Safety and Health Administration guidelines.
    • Training and Good Agricultural Practices (GAP): Providing education and training geared toward operational best practices.
    • Facility Buildouts: Assisting in the design and construction of compliant facilities for psilocybin operations.

    Experience in Navigating Emerging Industries

Allay Consulting prides itself on its rich background in cannabis, hemp, and emerging markets, equipping the firm with the skills needed to tackle the challenges of a developing psilocybin industry. Stuck highlights that the firm is well-versed in preparing for regulations that are yet to be established, thanks to its experience in similarly fragmented and rapidly-evolving sectors.

    The Regulatory Landscape Ahead

The regulatory framework surrounding both the THC-cannabis and CBD-hemp markets remains complex and disjointed. With various states implementing their own regulations—some legalizing cannabis for medical or recreational purposes while others maintain more conservative stances—the market experiences significant variations. Additionally, cannabis continues to grapple with its federal designation, which complicates any attempts at industry-wide standardization. Meanwhile, hemp is recognized federally following the 2018 Farm Bill, yet CBD derived from hemp still faces regulatory scrutiny from the FDA.

This depth of insight positions Allay Consulting to thrive as the psilocybin market unfolds, providing a critical service that will aid in navigating a landscape that is both promising and unpredictable.
