    Argentina’s New Regulation on Hemp and Medicinal Cannabis

    Argentina is making significant strides in the realm of hemp and medicinal cannabis regulation. Recently, the country’s Regulatory Agency for the Hemp and Medicinal Cannabis Industry (ARICCAME) announced the approval of a regulation designed to handle violations of its regulatory framework. This initiative is a crucial step toward ensuring the industry operates within a clear legal context.

    Key Provisions of the Sanctioning Procedure Regulation

    The new Sanctioning Procedure Regulation is effective immediately and targets non-compliance with licensing conditions and reporting obligations. Aimed at enhancing transparency and accountability, ARICCAME has outlined several key provisions:

    • Administrative Sanctions: Any violations of the regulatory framework can attract heavy penalties, including fines, suspensions of licenses, and in the most severe cases, revocation.

    • Due Process Assurance: The regulation ensures due process is upheld. Alleged violations can be reported either ex officio or through complaints by individuals or other administrative and judicial bodies.

    • Consequences of Non-Compliance: Failure to meet licensing obligations, such as fee payments and maintaining accurate records, could result in penalties. The agency holds the authority to suspend or revoke licenses based on the severity of the infraction, with a thorough administrative review guiding these decisions.

    A Framework for Accountability

    The development of the Sanctioning Procedure builds on previous regulations, including a licensing procedure set in place last year for non-psychoactive industrial hemp activities—covering essential areas such as seed, grain, and fiber production. ARICCAME’s mandate encompasses the regulation and control of cannabis-related activities, aiming to foster compliance and encourage sustainable growth within the hemp and medicinal cannabis sectors.

    The new regulation is indicative of Argentina’s commitment to creating a robust and competitive international landscape for hemp and medicinal cannabis, aligning with global best practices while placing a strong emphasis on public interest.

    The Legal Landscape of Hemp in Argentina

    Argentina took a significant step in regulating hemp by passing a law legalizing its cultivation in 2022. This legislation enables hemp to become a staple in agricultural practices, especially in a country where traditional crops like tobacco are in decline. Such reforms have the potential to spark innovation in technology and product development.

    Interestingly, Argentina has set its THC level for hemp at 1.0%. This decision places the nation ahead of the widely recognized global threshold of 0.3% THC, further pushing boundaries and adopting a more progressive stance towards hemp cultivation.

    However, while the legislation paves the way for industrial hemp, it notably excludes the processing of CBD. A decree issued in 2020 allowed for the importation of CBD and THC products for medical patients, but sales are limited strictly to pharmacies and require a doctor’s prescription.

    ARICCAME’s Established Role

    The establishment of ARICCAME in 2023 marked a pivotal moment in the regulation of the cannabis industry in Argentina. Designed to serve as a central clearinghouse, the agency is tasked with promoting research, technological advancement, and consumer safety while fostering collaboration with state agencies and universities.

    The Argentine Ministry of Science has allocated substantial funding—over $106 million—toward 13 research and development projects in cannabis and hemp across six provinces. Additionally, the government introduced Cannabis Conicet, a technology company aimed at advancing these sectors further.

    A Whole-Plant Strategy for the Future

    The Argentine government is advancing a whole-plant strategy that seeks to maximize the health and environmental benefits of hemp, while also promoting economic development. The envisioned uses of hemp cover a wide spectrum, including human and veterinary medicines, nutritional supplements, cosmetics, and various industrial applications. This comprehensive approach is set against the backdrop of ongoing research and technological development, indicating a promising future for the hemp and medicinal cannabis landscape in Argentina.
